Zachary Cole, paralegal at Rosenbaum Famularo, PC, talks about a used sold as new suspension case involving FBA returned items.

Our client was not selling products that were used. They were selling products legitimately. We had the invoices from the manufacturer / distributor showing that our client did in fact receive and sell new products on Amazon.com.

We ran into 2 issues with this used sold as new suspension case:

  1. FBA was being used by the client. A lot of the time, when a seller uses FBA, you’ll see a lot of instances of the FBA centers incorrectly processing returns because the Amz warehouses aren’t able to correctly process those returns.
  2. Other sellers on the listing weren’t following Amazon’s rules, selling used sold as new items, and then receiving negative feedback. Therefore, the listing page itself had bad comments. Unfortunately, Amazon may choose to associate that with your business.

Sellers’ Tip: Make sure you are doing everything by the books. Keep all invoices from manufacturers for at least one year and stay on top of all account issues. Keep your account healthy by providing excellent customer service.
