Recently, we defended a client who received a counterfeit complaint.
The seller was able to prove that the item was actually an authentic product.
To prove that a product is not counterfeit, a seller needs to show the product originated with the manufacturer and there is no material difference between their product and the manufacturer’s product.
The issue here was that after we reached out to the complainant, we noticed the amount on the package was not identical to what the listing said. That is an Amazon violation because it does not exactly match the listing details, but this does not make the product counterfeit.
A product not matching a listing will most likely result in an inauthentic complaint.
We were able to show Amazon that just because the number of items in the box were not the same did not mean that the items were counterfeit. The listing was then reinstated.
