Compiling a Witness List for Arbitration against Amazon

We represent sellers against Amazon if they refuse to reinstate your account or refuse to give you back your money / inventory.

The way we do that is by filing an arbitration against Amazon with the American Arbitration Association. That is probably one of the best parts of your contract with Amazon – that while you can’t go to court, you can take Amazon to arbitration.

Conor Wiggins, third year law student at Hofstra Law School talks to us about one of the many arbitrations we are handling:

Amazon ArbitrationThe first arbitration case Conor worked on today was compiling a witness list that will appear in our arbitration hearing when we go up against Amazon. This helps prepare our client to be ready and also helps prepare Amazon in how they are going to answer us when we get to arbitration.

On top of that, Conor also went and looked through five possible arbitrators that can actually hear us in this hearing. We look at them and their background to gain an understanding of who they are and where they are coming from. We try and choose one that can best understand our client’s unique business and hopefully rule in our favor in the arbitration.

The way to take Amazon to arbitration logistically is by filing a Demand for Arbitration and that gets filed with the American Arbitration Association and also gets sent to a very particular address that Amazon has on file to receive these documents. Once you file, Amazon responds. The next thing that happens is Triple A will send you a list of potential arbitrators.
